By using the services of Avlanc, you ("the User", "Client", "Customer") agree to abide by the following Terms of Service. These terms govern the use of all our services provided by Avlanc. Please read these Terms carefully before using our services.
1. REFUNDS
- All payments made are eligible for a refund within 48 hours of the original payment date. However, you may contact Avlanc within 7 days of the original payment via our billing portal to request a refund in the form of credits to your Avlanc account.
- Payments follow the 48-hour refund policy regardless of the service billing cycle. Dedicated services, Virtual Dedicated Servers, and Virtual Private Servers are final purchases and are not eligible for refunds. Avlanc will not negotiate any alternative form of return for these services. Any refund request will be denied.
- Refunds will only include the paid amount after deducting the tax fees imposed by the payment gateway.
- Overcharges are refundable only within the first month of the charge; after this period, overcharges will be classified as a normal payment.
- Add-ons are non-refundable.
- Upgrades and Downgrades are refundable only through credits to the Avlanc account.
- Refunds will take 5 to 7 business days to be credited to your bank account.
You will not be eligible for a refund under the following conditions:
- You exceed the 48-hour refund window.
- You no longer want the product.
- Your service was terminated due to violation of the Terms of Service.
- The issue is not related to server performance or is deemed invalid.
- Repeated refund requests without a valid reason, or without resolution, may result in ban or termination of your account.
2. DISPUTE
- Chargebacks: Initiating a chargeback will result in immediate termination of your account, suspension of services, and deletion of all associated data. Avlanc will provide evidence to the payment provider regarding the chargeback.
- To prevent chargebacks, users are encouraged to open a support ticket to discuss refund eligibility with a staff member before attempting any chargeback.
3. CREDITS
- Credits issued to your account are non-refundable.
- Credits can only be used for purchases within the Avlanc store and website.
- Attempting to exploit or misuse credits will result in all credits being removed from your account.
- Avlanc can transfer credits to another user upon request, via a support ticket.
4. ABUSE AND EXPLOIT
Avlanc reserves the right to suspend or terminate your service if you are found to be engaging in any of the following activities:
- Intentionally overloading or damaging the server or machine.
- Using copyrighted content without authorization.
- Exploiting the system for additional memory or resources.
- Overloading CPU (e.g., using plugins like Chunky or similar tools).
- Intentionally overloading storage or services.
- Abusing the billing system in any form.
5. MINECRAFT HOSTING
- Avlanc is not affiliated with Mojang, and does not claim ownership of Minecraft as a game.
- Avlanc provides services for hosting Minecraft servers but is not responsible for violations of Minecraft’s terms of service.
- Avlanc will not be liable for any malicious files installed on your server and may deny support at its discretion.
- Memory Allocation: Servers are allocated the full amount of memory purchased. Some in-game plugins may not display the full memory due to plugin settings and metaspace limitations.
A. Avlanc does not provide support for:
- Plugins, mods, or other forms of game modifications.
- Maps, datapacks, or other custom server implementations.
- In-game activities such as command block issues, player hacking, or similar activities.
- Domain setup for Minecraft servers.
B. Avlanc does provide support for:
- Server startup and connection issues.
- Modpack and version crashes via the game panel.
- Setup and configuration of addon services including:
- Bungeecord
- Geyser
- Dedicated IP setup
- Plugin support
- Avlanc is not responsible for world or file corruption and does not provide support for issues related to leaked or nulled jars used on your server.
Avlanc support will not assist with:
- Plugin configuration
- Mod modifications
- Full server setups
- Any detrimental actions against another service
6. DISCORD SUPPORT
- Avlanc provides support through its Discord server, but all users must adhere to the Discord community rules as well as Avlanc’ own server rules.
- Violations of either Avlanc' Discord rules or Discord’s Terms of Service may result in restricted access to the support scheme or the suspension/termination of your account.
- Discord support tickets are private between you and Avlanc support staff. The ticket author may request a transcript once the ticket is closed. Other users added to the ticket cannot request a transcript.
Avlanc will not provide Discord support for:
- Services not hosted by Avlanc.
- Disputes or commotion between users.
- Botting or griefing issues on servers.
- Issues related to Geyser setups.
- Billing-related matters such as service cancellations, transfers, or refunds.
- Discord tickets will automatically close if there is no response for 24 hours. Support staff may close a ticket earlier if it is determined to be resolved.
7. ACCOUNT AND SECURITY
- Account Responsibility: Users are responsible for securing their account information and credentials. Avlanc is not responsible for any issues arising from a user sharing their account details.
- Clients must protect their accounts by using strong passwords and, where available, enabling two-factor authentication (2FA).
- Avlanc retains ownership of all data within its platform, but we do not sell or share personal data. Accounts that have been inactive for 6 months may be subject to closure.
8. GOVERNING LAW AND JURISDICTION
- These Terms of Service and any disputes related to them will be governed by and construed in accordance with the laws of India.
- All disputes arising from or in connection with these Terms of Service shall be subject to the exclusive jurisdiction of the courts located in Noida, Uttar Pradesh, India.
9. CANCELLATION POLICY
- You may cancel your service at any time, but payments for the current billing cycle are non-refundable once processed.
- Any cancellation request or plan change must be made at least 10 business days before the end of your billing period.
- If no prior notice is given, your subscription will automatically renew for the next billing cycle.
- Failure to pay the next billing cycle on time may result in suspension of all services under your account without prior notice.
- All service cancellations must be submitted via the billing portal or official support system.
10. BACKUP POLICY
Avlanc services are provided at the User's own risk. The User is responsible for ensuring that their data is backed up and accessible when required.
Unless automatic backup systems are explicitly purchased from Avlanc, backups are not guaranteed and should not be relied upon. It is the User's responsibility to ensure that backups are active and functioning, and to maintain offsite copies of important data when needed.
11. PUBLIC DEFAMATION AND MISINFORMATION
- Users are expected to express criticism or dissatisfaction with Avlanc through appropriate and constructive channels such as support tickets or official feedback forms.
- Publicly defaming Avlanc (including but not limited to false accusations, unverified claims, or misleading statements) on any platform — including Discord, social media, or forums — without sufficient evidence may result in account suspension or service termination.
- This clause is not intended to infringe on free speech but to protect Avlanc from deliberate misinformation or damage to its reputation.
- Users found in violation of this clause will first be warned with the opportunity to provide evidence or retract false claims. Continued violations may lead to permanent bans from Avlanc services.
- This clause is subject to all applicable laws, including those governing defamation and freedom of expression under Indian and international jurisdiction.
